Khaliq Dad v. Noor Bibi,

YLR 2010 2785 · Balochistan High Court

This case involves a property dispute over a residential plot of land in Kharan, Balochistan. The plaintiff, Khaliq Dad, claimed he had lawfully purchased the land in 1992 from a man named Mandost, who he said had been officially allotted the land by the government in 1983. He sought a court declaration confirming his ownership and an order stopping the legal heirs of another man, Qadir Bakhsh, from interfering with the property, since they claimed the same land belonged to them.

The trial court initially ruled in the plaintiff's favor, but the appellate court (Majlis-e-Shoora) reversed this decision and dismissed his suit. The plaintiff then challenged that reversal before the Balochistan High Court.

The High Court upheld the appellate court's decision. It found that the plaintiff's sale document made no mention of the original 1983 allotment or any leasehold rights, and there was no explanation for the long gap between the alleged 1983 allotment and the 1992 sale. Since the land was government-owned, no valid transfer to a private party could occur without official sanction from the competent authority. The plaintiff could not prove he held valid legal title to the land, and the physical description of the land he claimed did not match what actually existed at the site.

This case highlights that when disputing ownership of state land, a claimant must produce clear, unbroken documentary proof of lawful allotment and transfer - unsupported claims of possession or informal sales are insufficient to establish ownership.
