Abdul Karim Mengal v. Sultan Badshah,

YLR 2010 2596 · Balochistan High Court

This case involved a dispute over Rs.80,00,000 that Sultan Badshah claimed was owed to him by Abdul Karim Mengal following the settlement of accounts from a partnership business. Badshah filed a recovery suit based on a dishonoured cheque, using a special fast-track procedure under Order XXXVII of the Civil Procedure Code, meant for cases involving negotiable instruments like cheques.

Mengal sought permission to defend the suit and also challenged whether the Quetta court had jurisdiction, arguing the cheque was issued and delivered in Kalat. The trial court rejected his jurisdiction objection, granted him permission to defend the case, but only on condition that he furnish security equal to the suit amount. When Mengal asked the court to reduce this security requirement, that request was also denied. He then challenged all three trial court orders before the Balochistan High Court.

The High Court first decided it did have authority to review this type of order, since such interim orders are not listed among those subject to regular appeal, meaning revision was the correct legal route. On the substance, the Court found that trial courts have discretion under the law to grant permission to defend a suit either freely or with conditions, including requiring security. Since Mengal failed to show any specific error or misuse of this discretion by the trial court, the High Court dismissed his revision petition, upholding the security requirement.
