Hazoor Bakhsh v. the State,
YLR 2010 2566 · Balochistan High Court
This case involved an application for pre-arrest bail by Hazoor Bakhsh, who was named as an accused in a criminal case involving an armed ambush and firing that injured several people. He was booked along with several others under charges including attempt to commit murder and rioting with deadly weapons.
Bakhsh remained a fugitive from justice for months after the FIR was filed, only surfacing after four of his co-accused were acquitted by the trial court. He claimed he had been unaware of the case against him and came forward voluntarily once he learned of it, and argued he should get the same benefit of acquittal as his co-accused.
The Balochistan High Court rejected his explanation as implausible, noting he lived in the same area as the other accused who had participated in the trial, making it unlikely he genuinely didn't know about the proceedings. The court also found his conduct improper because he tried to secure bail from the High Court without first surrendering to the trial court unconditionally, and he could not simply piggyback on his co-accused's acquittal.
The court withdrew the earlier ad-interim bail it had granted him and ordered his arrest. This case illustrates that courts are reluctant to grant pre-arrest bail to persons who deliberately evade the judicial process for extended periods, and that absconding from trial, followed by attempts to secure bail only after favorable developments for co-accused, will generally be viewed unfavorably by courts.
