Faiz Muhammad v. the State,
YLR 2010 2529 · Balochistan High Court
Faiz Muhammad was convicted under the West Pakistan Arms Ordinance for allegedly possessing an unlicensed Kalashnikov, two magazines and 39 live cartridges, and was sentenced to three years' imprisonment plus a fine. He appealed, arguing he was falsely implicated, that no independent witnesses were involved, and that the recovered weapon was never sent for forensic analysis.
The Balochistan High Court found serious problems with the case. The trial court's version of events, that police recovered the weapon while raiding the accused's house after learning of a murder, did not match the FIR at all. The FIR instead said police found the accused standing armed in an open plot near someone else's house late at night. There was no explanation for why he was there at that hour, nor any clear account of where the weapon and magazines were at the time of recovery. Crucially, while the Kalashnikov was produced in court, the alleged magazines and cartridges never were. Witness statements also contained contradictions that the trial court failed to notice.
Because the prosecution could not prove the recovery beyond reasonable doubt, and the accused was entitled to benefit of that doubt, the High Court set aside the conviction and acquitted Faiz Muhammad, ordering his release. The case highlights how inconsistencies between an FIR and trial testimony, plus missing evidence, can undermine a criminal conviction.
