Muhammad v. Dad Rahim,

YLR 2010 2512 · Balochistan High Court

This case comes from the Balochistan High Court and involves a dispute over land ownership in Gwadar. The petitioners (Muhammad and 15 others) claimed they were the rightful owners of a piece of land, but during official settlement proceedings, the land was recorded in the name of a private respondent, Dad Rahim. The petitioners said they were abroad at the time and only learned of this mutation later, prompting them to sue for a declaration of ownership, a permanent injunction, and correction of the land records.

Both the trial court and the appellate court had already dismissed their case, and they brought a revision petition to the High Court challenging those decisions.

The High Court also dismissed the petition. It found that none of the petitioners' witnesses actually supported their claim of ownership, and one of their own witnesses admitted the petitioners were present in the area during the settlement proceedings, contradicting their claim of being abroad and unaware. The court noted that settlement proceedings are conducted openly on the spot, and objections must be raised within six years, which the petitioners never did. Since they were neither the recorded owners nor in possession of the land, they had no legal standing under the Specific Relief Act to bring such a suit. The court also emphasized that settlement entries carry a strong legal presumption of correctness, which the petitioners failed to rebut with solid evidence.

This case highlights how important it is to timely challenge land record entries and how courts give strong weight to official settlement records unless clearly disproven.
