Secretary Government of Balochistan, irrigation Department v. Chandiazai Mengal Tribe through Malik Ghulam Qadir,

YLR 2010 2479 · Balochistan High Court

This case involved a dispute over water rights on a Bore Nala (water channel) in Balochistan. The Chandiazai Mengal Tribe sued the Irrigation Department and other government officials after they demolished a bund (embankment) that the tribe had built on the Nala in 1999, allegedly without notice or legal authority. The tribe based their claim on a 1921 arbitration award, upheld by the Political Agent in 1922, which had settled an earlier water-sharing dispute among four tribes using the Nala. Both the trial court and the appellate court had ruled in favor of the tribe, ordering the government to restore the bund at its own expense.

The Balochistan High Court overturned these rulings. It found that both lower courts had relied too heavily on the old 1921-22 award without properly examining more recent facts, particularly that a formal government irrigation scheme had been constructed in 1962. The plaintiff tribe failed to prove it still had a legal right, after 1962, to build a private dam on the Nala. The court held that the authorities were within their rights to remove unauthorized construction that affected water flow to thousands of other landholders in the area. Since the lower courts misread the evidence and ignored these key facts, the High Court set aside the decree and dismissed the tribe's suit.

This case matters because it clarifies that old customary or arbitration-based water rights do not automatically override government irrigation schemes and regulatory authority established later, especially when public interest and shared water resources are involved.
