Syed Ahmed Ali Shah v. Raja Muhammad Akhtar Khan,

YLR 2010 2455 · Balochistan High Court

This case involved a family dispute over agricultural land in Mouza Baroot, Hub, Balochistan. The petitioner claimed the land belonged to his late father and, after his father's death in 1991, passed to him, his brothers, and mother as legal heirs. He alleged that the respondents fraudulently got the land entered in their names in official revenue records without the family's knowledge, and later began claiming ownership and threatening to take possession.

The respondents countered that they had legally purchased the property from the petitioner's father during his lifetime, through the father's attorney, who happened to be the petitioner's own brother. They produced registered sale deeds and the attorney's own statement confirming the sale.

Both the trial court and the appellate court examined the evidence and ruled against the petitioner, finding that the respondents had validly acquired ownership through the sale transaction, while the petitioner failed to prove his claim of fraud or establish a superior right to the land.

The Balochistan High Court, hearing the petitioner's revision petitions, held that he had not shown any legal error or illegality in the lower courts' decisions. Since both courts had already thoroughly examined the facts and reached the same conclusion, the High Court found no grounds to interfere and dismissed the petitions.

This case illustrates how courts assess competing claims of inheritance versus prior sale transactions, emphasizing that clear documentary evidence of a registered sale can override claims of inherited title when the seller had authority to sell during their lifetime.
