Naseer Kakar v. State,

YLR 2010 2309 · Balochistan High Court

This case involved Dr. Naseer Kakar, a doctor at Helper Eye Hospital, Quetta, who was accused of misappropriating medicines worth over Rs. 82 lakh while allegedly serving as Incharge of the hospital's Medical Store between 1994 and 1997. He was convicted by the Special Judge, Anti-Corruption, Balochistan on charges of criminal breach of trust by a public servant, forgery, falsification of accounts, and criminal misconduct, and sentenced to multiple years of imprisonment with heavy fines.

On appeal, the Balochistan High Court overturned the conviction and acquitted him. The court found that the prosecution never proved he was actually appointed Medical Store Incharge, since no official notification supporting this claim was produced, only a vague claim that he was given charge orally. The court noted such an important post could not be assigned informally, and no one could explain who supposedly gave him this responsibility. Additionally, key documents like indents showed alterations that the Medical Superintendent disowned in court, and the crucial Stock Register that could prove whether medicines were actually received and misused was never presented. The court also noted others responsible for managing medicines, like the Medical Superintendent and Store Incharge, were not held accountable.

This case matters because it highlights how criminal convictions require solid, direct proof of a person's official role and actions, not assumptions or informal arrangements, especially when serious corruption charges and heavy penalties are involved.
