Abdul Raziq v. the State,

YLR 2010 2234 · Balochistan High Court

This case involves Abdul Raziq, who was convicted by a Sessions Court in Loralai for possessing an unlicensed Kalashnikov rifle and 28 live cartridges, in violation of the West Pakistan Arms Ordinance, 1965. He was sentenced to three years of rigorous imprisonment plus a fine.

Raziq's defense was that he had merely accepted a ride from an acquaintance, Hidayatullah (who was wanted in a separate murder case), and had no idea a weapon was hidden in the car. He claimed the rifle actually belonged to another passenger, Muhammad Din, and alleged that Frontier Corps personnel had falsely implicated him and planted the weapon after an argument, possibly to cover up letting Din go free improperly.

The Balochistan High Court rejected his appeal. The judge noted that Raziq never denied the rifle was found at the scene, and importantly, the rifle was recovered hanging from his own shoulder, not from Din. He failed to prove Din was even present in the vehicle, and his witnesses gave contradictory accounts. Crucially, he never raised the "personal grudge" or planted-evidence theory during the actual trial, only bringing it up later on appeal, which the court viewed as an afterthought rather than a genuine defense.

Finding no error in how the trial court had evaluated the evidence, the High Court upheld the conviction and dismissed the appeal, reinforcing that new, unexplained defense theories raised only at the appellate stage carry little we
