Jaffar Khan v. the State,

YLR 2010 2205 · Balochistan High Court

This case involved Jaffar Khan, who was convicted in two separate criminal cases arising from incidents of house-trespass and theft reported on the same day in 2008. In one case, he was sentenced to two years for lurking house-trespass and three years for theft, with fines, and the trial court ordered these two sentences to run concurrently. In the second case, he received similar sentences, which were also ordered to run concurrently within that case. However, no court had specified whether the sentences from the two separate cases should run concurrently with each other or one after the other (consecutively). Since the law defaults to consecutive sentencing unless a court specifically orders otherwise, this meant Khan faced a combined total of six years in prison.

Khan filed an application asking the Balochistan High Court to direct that the sentences from both cases run concurrently, arguing he was innocent and had already been denied this benefit by lower courts.

The High Court examined the relevant legal provisions and noted that no explicit concurrency order existed between the two cases. However, considering Khan's youth, poor financial background, and lack of any prior criminal record, the judge decided a lenient approach was warranted. The court allowed the application, directing that the sentences from both cases run concurrently. It clarified, though, that additional jail time imposed for failure to pay fines could not be included in this concurrent arrangement, since such default sentences aren't treated as ordinary imprisonment under the law. This case matters because it shows courts can exercise discretion to reduce effective prison time based on an offender's circumstances, even after conviction.
