Muhammad Qasim v. Ahsan Raza,
YLR 2010 2139 · Balochistan High Court
This case involved a dispute over the ownership and control of Quetta Public High School and an attached residential flat. A complaint was filed under the Illegal Dispossession Act, 2005, alleging that Ahsan Raza and others had forcibly occupied the school building and flat, taking the resident family hostage. The trial court took up the case, found the occupier unable to justify his possession beyond a suspicious document, and ordered the property attached with a court official appointed to manage its accounts while the case proceeded.
Later, the original complainant tried to withdraw the complaint, and the trial court allowed this withdrawal, reasoning that ordinary criminal procedure permitted such withdrawal. This decision was challenged before the Balochistan High Court.
The High Court ruled that the Illegal Dispossession Act is a special law with its own procedure, and it contains no provision allowing withdrawal of a complaint once filed. Since the trial court had already taken up the case under this special law, it was obligated to decide it according to that law's specific procedure, not general withdrawal rules. The High Court therefore set aside the withdrawal order, ruling the complaint would be treated as still pending.
On the separate question of attaching the property, the court upheld the attachment, noting both sides claimed ownership and the school was generating significant income, so preserving the property under court supervision protected everyone's interests. The case was sent back to the trial court to continue proceedings properly under the Act.
