Amanullah v. Rohi Muhammad,
YLR 2010 2083 · Balochistan High Court
Amanullah v. Rohi Muhammad is a decision of the Balochistan High Court dealing with a landlord's request to evict tenants from a shop for non-payment of rent and because he genuinely needed the property for his own use.
The landlord said he bought the shop through a registered sale deed in 2004 from its previous owners, and that the existing tenant was informed of this change. When the landlord asked for the shop back, the tenant requested and got six months, on condition of paying rent, but then stopped paying. The tenants disputed this: they claimed to have earlier purchased the shop themselves from a prior owner in 1996 through an unregistered agreement, with part of the price still unpaid, and denied being tenants of the current landlord at all. They had also filed a separate civil suit over that disputed sale.
The Rent Controller had ruled in the landlord's favor, finding that a landlord-tenant relationship existed, that the tenants failed to pay rent, and that the landlord genuinely needed the shop for personal use. The tenants had failed to prove any legal title of their own.
The High Court upheld these findings, agreeing that the landlord had proven both default in rent and genuine personal need, while the tenants had acted in bad faith by denying his ownership to avoid paying rent. The court ordered immediate eviction and directed that rent be paid up until possession is actually handed back to the landlord. The case illustrates that rent disputes are decided on tenancy facts, not on unresolved ownership litigation pending elsewhere.
