Kala Khan Tareen Coal Company Duki v. Mehrab Khan,

YLR 2010 1969 · Balochistan High Court

This case involved a dispute over a coal mining lease in Loralai, Balochistan. The petitioner, Kala Khan Tareen Coal Company, claimed it held a mining lease and had been illegally dispossessed by the respondents, who allegedly moved onto the leased area and began extracting coal without authorization. The company filed a complaint under the Illegal Dispossession Act, 2005, a special law designed to provide quick relief to people forcibly and unlawfully removed from property they possess. The trial court dismissed the complaint after investigation, and the company challenged that dismissal before the Balochistan High Court.

The High Court upheld the dismissal. It explained that under this Act, the only real question is whether someone in possession was wrongfully deprived of that possession without lawful excuse; disputes about ownership or title are not meant to be resolved through this fast-track process. Here, the complainant failed to specify exactly when the dispossession occurred, the precise boundaries or area involved, or whether the entire leased area was affected. It also waited more than a year to file the complaint without explanation, undermining its claim of urgent, wrongful dispossession. Since a civil suit and constitutional petition over the same property were already pending, the court held those proceedings were the proper venue to determine rights and ownership.

The case illustrates that the Illegal Dispossession Act is meant only for clear-cut, prompt dispossession claims, not for resolving long-running property or title disputes better suited to civil courts.
