Abdul Sattar v. State,

YLR 2010 1946 · Balochistan High Court

This case involved a man, Abdul Sattar, who had stood as a guarantor (surety) for an accused person, Noor Ali, allowing him to be released on bail. Sattar deposited Rs. 2,00,000 in cash as security to guarantee that the accused would appear in court. When the accused failed to appear and could not be produced, the trial court forfeited Rs. 1,50,000 of the surety amount as a penalty. Sattar challenged this before the Additional Sessions Judge, who upheld the forfeiture, so he approached the Balochistan High Court asking for the amount to be reduced.

The High Court held that standing surety for someone is generally an act of goodwill, and a guarantor should not be punished harshly unless there is evidence he acted for personal gain or with bad intent in helping the accused get bail. Since there was no proof that Sattar benefited financially or acted with ulterior motives, and the trial court had not properly justified such a heavy penalty as required under Section 514 of the Criminal Procedure Code, the forfeiture was excessive.

The Court reduced the fine from Rs. 1,50,000 to Rs. 80,000 and ordered the remaining Rs. 1,20,000 to be returned to Sattar. This case matters because it clarifies that courts must balance fairness and proportionality when penalizing sureties, rather than automatically imposing maximum penalties.
