Hasil Khan and another V. The State and another,

YLR 2010 1209 · Balochistan High Court

This case involved Hasil Khan, who was convicted for possessing an unlicensed pistol under the West Pakistan Arms Ordinance, 1965. The background was that during investigation of a separate murder case, Khan disclosed information about a weapon and led police to his home, where a T.T. pistol was recovered from beneath his quilts. Since he could not produce a license for the weapon, a new case was registered against him, and he was convicted by the trial court and sentenced to two years' rigorous imprisonment plus a fine.

Khan appealed, arguing that the recovery was fabricated by police and that the mandatory procedure under Section 103 of the Criminal Procedure Code (which normally requires independent witnesses to be present during searches and recoveries) had not been followed.

The Balochistan High Court rejected these arguments. It held that when a recovery is made based on an accused person's own disclosure leading police to hidden evidence, strict compliance with Section 103 is not required. The court found the police witnesses' testimony consistent and credible, noting that despite extensive cross-examination, nothing emerged to discredit their accounts, and no enmity between the witnesses and the accused was alleged.

The appeal was dismissed, and the conviction and sentence were upheld. This case illustrates how courts treat "disclosure-based" recoveries differently from ordinary searches, and reinforces that consistent, unchallenged police testimony can be sufficient to sustain a conviction.
