Gul Wali v. Widow of Sheikh Ghulam Nabi,

YLR 2010 1184 · Balochistan High Court

This case concerns a dispute over a rented shop in Quetta between a tenant, Gul Wali, and the heirs of the shop's late owner. The shop had been let out by the owner's uncle under a rent agreement, but it later emerged that the uncle had obtained an ex parte decree through misrepresentation and fraudulently transferred the property into his own name. Once this was discovered, the rightful heirs got the fraudulent decree set aside and the property records corrected in their favor. When they demanded rent from the tenant, he refused to acknowledge them as landlords, leading to eviction proceedings before the Rent Controller.

During the case, the Rent Controller ordered the tenant to deposit monthly rent under Section 13(6) of the Rent Restriction Ordinance. The tenant challenged this, arguing that since the landlord-tenant relationship was disputed, no such rent deposit order could be made, and his defence should not have been struck off for non-compliance.
