Liaquat Ali v. Sabrullah,

YLR 2010 1083 · Balochistan High Court

This case involved a man named Muhammad Islam who was shot and killed in Washuk in December 2006. The complainant, Liaquat Ali, filed a criminal case against nine people, accusing them of murder and rioting under the Penal Code. After trial, the Additional Sessions Judge acquitted all the accused, finding the evidence insufficient. The complainant then appealed this acquittal to the Balochistan High Court.

The High Court dismissed the appeal and upheld the acquittal. It found that none of the prosecution witnesses actually saw the named accused fire the fatal shots; instead, they blamed an absconding accused who was not part of this appeal. No weapon was recovered from the accused, and there was no independent evidence supporting the complainant's version. The court also noted there was no proof the accused shared a common purpose or formed an unlawful assembly, which is required for group liability in such cases. It found it suspicious that as many as nine people were implicated for a single killing, suggesting possible false implication of some accused.

The judgment reaffirms an important principle: when reviewing an acquittal, courts must presume innocence twice over and should not overturn it just because another view of the evidence is possible. Acquittals are only reversed if the original decision was clearly perverse or ignored crucial evidence. This case illustrates how Pakistani courts protect the acquitted from being punished twice through appeals based on weak or exaggerated evidence.
