Hasil Khan and another V. The State and another,

YLR 2010 1006 · Balochistan High Court

This case from the Balochistan High Court concerned a man, Hasil Khan, who shot and killed Saeed Bakhsh while the victim was travelling home by bus after a wedding, also wounding a child and a woman in the process. The trial court had convicted him of murder under section 302(b) of the Pakistan Penal Code but sentenced him only to life imprisonment, partly because it treated a court document he produced as a mitigating factor, without it being formally proved.

Both sides appealed: the convict challenged his conviction, while the complainant sought the death penalty instead of life imprisonment. The High Court examined the evidence and found the eyewitnesses, including the complainant, to be consistent and credible, with no serious contradictions. It held that minor issues, such as the witnesses being relatives of the deceased or the absence of independent witnesses during recovery of the murder weapon, did not undermine the prosecution's case, especially since the weapon was recovered based on the accused's own disclosure. Medical evidence and a clear motive further supported the case.

The court ruled that the trial court had wrongly relied on an improperly exhibited document to justify a lesser sentence, when no genuine mitigating circumstances existed. Emphasizing that courts should not dilute punishment for premeditated murder on flimsy grounds, and that deterrent sentencing serves an important social purpose, the High Court upheld the conviction and enhanced the sentence from life imprisonment to death.
