Suit for Possession through Pre-emption

YLR 1194), “Haji Hassan Ali Vs Haji Abdullah and another” (PLJ 2006 · Lahore High Court (Rawalpindi Bench)

This case is about a property pre-emption suit, which under Pakistani law allows certain people, such as co-owners, to claim the right to buy property before an outside purchaser's sale is finalized, provided strict legal procedures are followed.

Mst. Zahida Perveen sued to take possession of land through pre-emption, claiming she was a co-owner with first right to purchase it, and that the recorded sale price was fraudulently inflated to defeat her claim. Pakistani pre-emption law requires two formal steps: an immediate declaration of intent to pre-empt upon learning of the sale (Talb-e-Muwathibat), and a formal notice to the buyer (Talb-e-Ishhad). The trial court and the appellate court both dismissed her suit, finding these requirements were not properly proven.

The key issues before the High Court were whether failing to produce the informant (the person who told her about the sale) was fatal to her case, and whether other witnesses could substitute for that testimony. The petitioner's own father-in-law testified on her behalf, but she herself never appeared as a witness, and the informant, her brother, was never called despite being the best source of evidence. The respondent argued her statement only showed she "decided" to pre-empt rather than making an immediate, unequivocal demand as required by law, and noted problems with how the Talb-e-Ishhad notice was handled and proven.

This judgment matters because it reinforces how strictly courts enforce the technical requirements of pre-emption claims, including who must testify and how quickly and clearly the right must be
