When complaint for illegal dispossession is not competent
· Not specified
This case was about a woman, Mst. Neelam Parveen, who filed a criminal complaint claiming she had been illegally dispossessed of land that belonged to her late husband. She said she stayed connected to the property until 1995, after which the accused persons took it over with the help of the land's previous owners. The accused, on the other hand, claimed they were genuine buyers of the land, having purchased it through a properly sanctioned mutation (an official land transfer record).
The Lahore High Court examined whether this dispute could be pursued as a criminal complaint under the Illegal Dispossession Act, 2005, which is meant to punish land grabbers and criminals who forcibly dispossess people of their property. The court found that this was essentially a civil property dispute, not a criminal matter of forcible dispossession. Importantly, the complainant herself admitted she was not in physical possession of the land, which contradicted her claim that she was forcibly dispossessed. Since the accused held a valid mutation and did not fit the profile of land grabbers or criminals targeted by the Act, the court ruled that the proper remedy was to file a civil suit to reclaim ownership or possession, not a criminal complaint.
The court dismissed her petition, finding no legal error in the lower court's decision. This case clarifies that the Illegal Dispossession Act is meant for genuine criminal land-grabbing, not for resolving ordinary ownership or title disputes, which belong in civil courts.
