PLJ 2021 Islamabad 40 - Withholding of Outstanding Dues

SCMR 2027) and · Islamabad High Court

Getz Pharma, a pharmaceutical company, had employed several individuals as sales managers. These employees either resigned or were dismissed after the company accused them of breaching their contracts and violating a conflict-of-interest policy by setting up a rival business, Sun Health Care, while still employed. As a result, the company withheld their final dues, including gratuity, relying on a rule that denies gratuity to employees dismissed for misconduct or who resign under such circumstances.

The employees filed claims under Section 15 of the Payment of Wages Act, 1936, before the Assistant Commissioner/Magistrate, who ordered the company to pay the outstanding dues and compensation.
