Reported case on partition by lahore high court

· Not specified

This case involved a property dispute between family members over the partition (division) of jointly owned land in Attock. The respondents had filed a partition suit, and after a preliminary decree was passed, a local commission (a court-appointed lawyer) was tasked with working out the practical division of the property. The parties reached a compromise before the commission, and based on that, the trial court passed a final judgment and decree for partition. The petitioner, Karam Elahi, challenged this outcome, first before the District Court, which dismissed his appeal, and then before the Lahore High Court through this civil revision petition.

The petitioner argued that he never agreed to the compromise, that the property had already been informally divided decades earlier, and that the partition would lead to demolition of his house. The High Court rejected these arguments. It held that since the petitioner had not challenged the original preliminary decree, he could not now argue that the property was already divided or indivisible, citing Section 97 of the Civil Procedure Code. The court also found that he had in fact signed the compromise agreed before the commission, which involved an equitable exchange of passages between the parties' properties.

Since two lower courts had already agreed on the facts and the arrangement seemed fair, the High Court declined to interfere and dismissed the petition. This case illustrates how courts enforce procedural rules requiring timely objections and respect compromises reached during partition proceedings.
