PTD 2025 65 · Balochistan High Court
This case involved a legal dispute over whether a truck used to transport smuggled goods should be permanently confiscated or could be released back to its owner after paying a fine.
Customs officials in Khuzdar intercepted a truck carrying plastic shopper bags hidden in a cavity near the front of its container, in violation of customs and import control laws. The Customs Collectorate confiscated the vehicle outright, arguing the goods were hidden in a specially designed secret compartment, which under customs rules (SRO 499(I)/2009) would bar release of the vehicle even on payment of a fine. However, the Customs Appellate Tribunal disagreed and ordered the vehicle released upon payment of a 20% redemption fine, finding that the vehicle did not actually have a false or secret cavity.
The Collectorate challenged this decision before the Balochistan High Court. The Court dismissed the challenge, holding that "liable to confiscation" under the Customs Act does not automatically mean a vehicle "must be confiscated" — the law also allows for fines instead of outright confiscation, unless specific goods are exempted by the tax authorities. The Court also noted that the official notice against the owner did not clearly describe a "secret" cavity, and the Tribunal's factual finding on this point could not be re-examined by the High Court in this type of case.
This ruling clarifies that customs authorities cannot automatically seize vehicles without properly proving hidden compartments, protecting vehicle owners from overly harsh confiscation.
