PTD 2021 993 · Balochistan High Court

This case involved a bus that crossed into Pakistan from Iran carrying goods far exceeding what pilgrims would normally bring as personal baggage. Customs officials searched the bus and found foreign goods worth over Rs. 2.98 million, even though only about five pilgrims were on board. Authorities seized the goods, suspecting they were being smuggled disguised as pilgrim baggage, and the Additional Collector of Customs ordered confiscation, imposing penalties and allowing the owners to redeem the goods and vehicle by paying fines and duties.

The Customs Appellate Tribunal later overturned the penalty and redemption fine, reasoning that the goods were simply pilgrims' baggage and should have been handled under baggage rules by a different customs authority, and that the people involved had already paid duties and taxes in good faith.

The Balochistan High Court disagreed with the Tribunal.
