PTD 2021 1764 · Balochistan High Court
Meerab Enterprises imported two consignments of pistachios from Iran through a land route and declared their value for customs purposes. The customs appraising officer assessed a slightly higher value and the company paid duty and taxes accordingly. However, before the goods could be released, officers of the Directorate of Intelligence and Investigation seized the consignments, alleging that a Valuation Ruling had not been properly applied and that this caused revenue loss to the government.
The company challenged the seizure in the Balochistan High Court, arguing that the Directorate had no authority to seize goods on this basis. The court examined the relevant law, particularly a 2007 government notification defining the powers of the Directorate. It held that intelligence officers can only intercept and seize goods when there is misdeclaration of the description, quality, or quantity of goods leading to revenue loss. They have no jurisdiction to seize goods merely because a Valuation Ruling was allegedly not applied correctly or was wrongly applied, since that determination falls outside their domain.
Based on this reasoning, the court accepted the petition and declared the seizure report void and legally ineffective.
This case matters because it clarifies the limits of power of customs intelligence agencies, ensuring they do not overstep into valuation disputes that belong to other authorities, thereby protecting importers from arbitrary seizures based on disagreements over customs valuation methods rather than genuine misdeclaration.
