PTD 2021 1035 · Balochistan High Court
This case involved a vehicle (a Hino Coach) that was stopped by customs officials near Winder City after it tried to flee instead of halting at a checkpoint. The driver abandoned it, and customs officials discovered specially built false cavities in the vehicle containing smuggled foreign-origin goods, including betel nuts, Monosodium Glutamate, tyres, and auto parts. Since nobody claimed ownership of either the goods or the vehicle, customs authorities seized both.
An Additional Collector ordered the goods and the vehicle confiscated outright, since the vehicle had false cavities and was used for smuggling. The owner's appeal to the Collector was dismissed, but the Customs Appellate Tribunal later softened the punishment, allowing the vehicle to be released back to its owner if he paid a 20% redemption fine instead of losing it outright.
The customs department challenged this leniency before the Balochistan High Court. The High Court sided with the department, ruling that under the relevant law (Section 181 of the Customs Act and SRO 499(I)/2009), when a vehicle is found with built-in secret compartments specifically used for smuggling, the owner cannot be given the option to pay a fine to get it back - it must be confiscated outright. The Court held the Tribunal's decision to release the vehicle violated the law, and ruled in favor of the customs authorities, restoring the confiscation order.
