The Collector of Customs, Model Customs Collectorate, Quetta V. Messrs Al-Habib Enterprises and Engineering and others,

PTD 2019 1712 · Balochistan High Court

Naeem Akhtar Afghan, J.

This case concerned six used concrete transit mixer trucks imported from China into Pakistan through Quetta. The importer submitted pre-shipment inspection certificates stating the trucks were no more than five years old. Customs officials assessed and charged duties based on these documents, and the trucks were cleared and released after payment. Later, on inquiry with the manufacturer, customs discovered that the trucks were actually older than declared, some manufactured as far back as 2004. Based on this, the Additional Collector of Customs (Adjudication) issued show-cause notices and imposed heavy penalties on both the importer and the inspection company for misdeclaration.

The importer appealed, and the Customs Appellate Tribunal set aside these penalty orders. The Collector of Customs then challenged the Tribunal's decision before the Balochistan High Court.

The High Court upheld the Tribunal's decision and dismissed the Collector's references. It held that once goods have been assessed under Section 80 of the Customs Act, duties paid, and goods cleared under Section 83, the proper remedy for the customs department to challenge that assessment is to file an appeal under Section 193 of the Act—which was not done here. The Additional Collector (Adjudication) had no jurisdiction to issue a fresh show-cause notice or penalize the importer after clearance without following this route. Since no legal question warranting the High Court's intervention arose, the references were dismissed.
