Messrs Khan Gul Government Contractor V. Federation of Pakistan through Secretary/Chairman, Federal Board of Revenue, Islamabad and another,
PTD 2018 415 · Balochistan High Court
This case is about six vehicles imported by a government contractor that were held back by Customs authorities, who claimed the vehicles were older than five years, exceeding the age limit allowed under Pakistan's Import Policy Order, 2016 for specialized vehicles used in construction, mining, oil, gas and petroleum sectors. The importer had submitted an inspection certificate from an approved company confirming the vehicles met the age requirement, paid all duties and taxes, but Customs still refused to release the vehicles, relying instead on a certificate from a different source and a notice issued under Section 171 of the Customs Act.
The Balochistan High Court found that under Section 168 of the Customs Act, once goods are seized, authorities must prepare a seizure memo and issue a formal show-cause notice within two months, unless the Collector of Customs formally extends that deadline in writing with reasons. In this case, Customs did neither. The court ruled that a notice under Section 171 is not a legal substitute for the mandatory show-cause notice required under Section 168, and that failing to follow this procedure meant Customs no longer had the authority to keep holding the vehicles.
The court ordered the vehicles released. The case matters because it reinforces the principle that government agencies must strictly follow procedures set out by law, and citizens benefit when authorities fail to meet legally mandated deadlines and requirements.
