Messrs United Agro Chemicals through authorized dealer and another V. Government of Pakistan through Collector Customs House and 2 others,

PTD 2016 582 · Balochistan High Court

This case concerned three trucks carrying imported DAP fertilizer that were stopped by Pishin levies at a checkpoint in Balochistan and handed over to the Frontier Corps, on suspicion that the fertilizer was being smuggled out of Pakistan into Afghanistan. Customs authorities seized the trucks and fertilizer and later issued a legal notice to the transporter under the Customs Act, 1969.

The company that imported the fertilizer from Australia, along with its authorized dealer who was transporting it to local farmers, challenged this action in the Balochistan High Court. They argued the fertilizer was legally imported, was meant for agricultural use in nearby villages, and was seized deep inside the country, far from the Pak-Afghan border, not while attempting to cross it.

The court agreed with the petitioners. It held that since the fertilizer was lawfully imported and the trucks were intercepted in the interior of the country rather than at the border, no smuggling offense under the Customs Act had actually occurred. Mere suspicion that the goods might eventually be smuggled across the border was not sufficient legal ground for seizure or for initiating customs proceedings. The court ruled that the interception, seizure, and subsequent notice were without lawful authority, ordered the trucks and fertilizer released to the petitioners, and quashed the proceedings. This case highlights that authorities cannot punish people based on assumptions about future illegal acts; actual violation of law at the relevant place (the border) is required.
