PTD 2016 1419 · Balochistan High Court
This case was about a company that imported steel strand from China and declared its customs value at a certain price. Customs officials rejected that declared value, saying it was too low, and instead assessed duty and taxes based on an official Valuation Ruling (No. 370 of 2011) issued by the customs authorities, which set a much higher price per kilogram. The importer disagreed, arguing that customs should have followed the standard step-by-step valuation process under Section 25 of the Customs Act rather than relying on the ruling, and complained it was not given a hearing before the final assessment.
The company approached the Balochistan High Court directly under its constitutional jurisdiction, challenging the valuation ruling and the resulting assessment.
The court dismissed the petition. It held that assessment orders made under Section 80 of the Customs Act are appealable, and valuation rulings themselves must be challenged through the specific remedy provided under Section 25-D of the Customs Act, with further appeals available under Section 193. Since the law already provided proper channels to contest both the valuation ruling and the assessment, the importer should have used those remedies instead of coming straight to the High Court.
The judgment reinforces an important principle: constitutional petitions are not meant to bypass normal legal procedures. Courts will only intervene directly when an order is clearly without jurisdiction, contrary to settled law, or likely to cause a miscarriage of justice—none of which applied here.
