Muhammad Akbar through Attorney V. Government of Pakistan and 2 others,
PTD 2015 116 · Balochistan High Court
In 1994, Muhammad Akbar was intercepted by customs officials at Gwadar airport with foreign-origin gold found on him, and he was charged under the Customs Act. A special customs court tried him and acquitted him in December 1994, finding that the prosecution had not proven its case, partly because he claimed he intended to declare the gold and pay duty on it. However, the acquittal only cleared him of criminal liability; it said nothing about ownership or return of the seized gold itself.
More than sixteen years later, in 2010, Akbar filed a constitutional petition in the Balochistan High Court asking that the customs authorities be directed to return the gold to him upon payment of the applicable customs duty.
The High Court dismissed the petition outright. It held that the matter was barred by extreme delay (laches), since 16 years had passed since seizure. More importantly, the Customs Act itself provides a complete process for dealing with confiscated goods: adjudication by customs authorities under section 179, followed by appeal and revision under sections 193 and 196. Akbar never used these remedies. The court clarified that a criminal trial court's acquittal does not extend to deciding the fate of confiscated goods, which falls exclusively within the customs authorities' jurisdiction. Since no order of the customs adjudicating authority was ever challenged, and an effective alternate remedy existed, the constitutional petition was not maintainable and was dismissed.
