Coll: of Customs Qta v. Custom Sale Tax & C. Excise,
PTD 2013 59 · Balochistan High Court
This case involved a dispute over smuggled scrap iron and steel seized by Pakistan Customs officials near Quetta in 2004. Customs staff had intercepted three trucks carrying the goods without proper import documents, leading to confiscation of both the scrap and the vehicles, though the vehicle owners were given the option to pay a redemption fine to reclaim their trucks. The vehicle owners appealed, and the Collector (Appeal) allowed release of the vehicles on payment of the fine. Later, the Customs Appellate Tribunal set aside the original confiscation order entirely.
The Collector of Customs challenged this before the Balochistan High Court, arguing that the Tribunal's single member did not have the legal authority to decide the case because, at the relevant time, single members could only hear cases where the value of goods was up to Rs.100,000 - but the seized goods here were valued at over Rs.500,000. The vehicle owners argued that a later rule change raised this limit to Rs.500,000, which should apply.
The High Court ruled that the higher monetary limit could not be applied retroactively, meaning the Tribunal's single member lacked jurisdiction to decide the case when it did. Because of this, the Tribunal's order was set aside, and the case was sent back for a fresh decision by a properly authorized bench. This case highlights the importance of tribunals staying within their legal authority based on the value of matters involved.
