Collector of Customs, Federal Excise and Sales Tax, Quetta v. Ramzan,

PTD 2013 440 · Balochistan High Court

This case involved a bus intercepted near Gaddani carrying 5,100 liters of smuggled Iranian petrol in 75 plastic cans. Customs officials seized both the goods and the vehicle. The petrol was confiscated outright, but the vehicle's owner was given the option to get it back by paying a redemption fine set at 30% of the vehicle's customs value, as per the original Assistant Collector's order.

The vehicle owner appealed, and eventually the Customs Appellate Tribunal reduced this fine significantly, to a flat Rs. 30,000, regardless of the vehicle's value. The Collector of Customs challenged this reduction before the Balochistan High Court, arguing that the Tribunal had ignored the legal framework requiring a percentage-based fine.

The High Court examined Section 181 of the Customs Act, 1969, which allows fines in lieu of confiscation, and a government notification (S.R.O. 574(I)/2005) which mandates that such fines must be at least 30% of the vehicle's customs value when it was used to transport smuggled goods. The court found that the original 30% fine imposed by the Assistant Collector was correct and lawful, in line with binding precedent from a similar case. However, despite finding merit in the Collector's legal argument, the court ultimately dismissed the reference application.

This case clarifies that fines for vehicles used in smuggling must follow the fixed percentage set by regulation, not be arbitrarily reduced, ensuring consistency in how customs penalties are applied
