Collector of Customs and Customs Collectorate, Balochistan  V. Abdul Sattar,

PTD 2012 28 · Balochistan High Court

This case involved a dispute between the Customs authorities in Balochistan and a man named Abdul Sattar, whose truck was stopped by Customs officials on suspicion of carrying smuggled goods. The truck was found carrying empty drums, caps, cans, and iron and steel scrap. When the driver could not immediately produce import documents, Customs seized the goods and the truck under the Customs Act.

Abdul Sattar later showed that he had legally purchased the scrap material through an open auction conducted by Descon Engineering Limited, a company working on the Meerani Dam project. Lower authorities rejected this explanation, arguing the auction was invalid because Customs approval had not been obtained beforehand. However, the Customs Appellate Tribunal ruled in Sattar's favor, ordering the goods released and any fines refunded.

Customs then challenged this decision before the Balochistan High Court. The High Court upheld the Tribunal's ruling.
