Collector Customs v. Manan Khan,
PTD 2011 2778 · Balochistan High Court
This case involved a dispute over a confiscated vehicle suspected of being smuggled or fraudulently registered. Customs authorities had seized the vehicle, alleging that its engine number was tampered with and that it was linked to forged documents, as supported by forensic evidence from the Police Crimes Branch. However, a Special Judge (Customs) acquitted the accused, Manan Khan, in the related criminal case, accepting that the vehicle's registration book was genuine. The Customs Appellate Tribunal then relied entirely on this criminal acquittal to also rule in the respondent's favor, ordering the vehicle's release, without independently examining the customs-related evidence or facts.
The Collector of Customs challenged this before the Balochistan High Court (sitting as Quetta High Court), arguing that the Tribunal wrongly treated the criminal acquittal as automatically deciding the separate customs case, without considering the actual evidence of forgery and smuggling before it.
The High Court agreed with the Customs Department. It held that criminal trials and customs adjudication proceedings are distinct and operate under different legal provisions, so an acquittal in one does not automatically determine the outcome in the other. The Tribunal was required to independently assess the evidence and apply its own reasoning, which it failed to do. Consequently, the Court set aside the Tribunal's order.
This ruling matters because it clarifies that customs confiscation proceedings must be decided on their own merits and evidence, separate from parallel criminal prosecutions, ensuring
