Ibrahim Shah V. Pervez Rana,
PLJ Cr.C 2018 Quetta 130 · Balochistan High Court
This case is about a civil lawsuit for damages based on malicious prosecution. Ibrahim Shah had been charged in a criminal case filed by Pervez Rana, accusing him of demolishing a wall and related offences. After trial, Ibrahim Shah was acquitted, but only on benefit of the doubt, not because the court found him clearly innocent. Believing the criminal case against him was false and filed out of malice to harass him and damage his reputation and business, Ibrahim Shah sued Pervez Rana for over 36 lakh rupees in damages. The trial court dismissed his suit, and he appealed to the Balochistan High Court.
The High Court upheld the dismissal. It explained that to win a malicious prosecution case, a plaintiff must prove three things: that the earlier criminal case ended in his favour, that the person who filed it acted out of malice, and that they had no reasonable or probable cause for filing it. Simply being acquitted, especially on benefit of the doubt rather than a clear finding of innocence, is not enough on its own. Ibrahim Shah failed to prove malice or lack of reasonable cause, so his case failed. The court found the trial court's judgment well-reasoned and free of errors.
This case matters because it clarifies that an acquittal alone does not automatically entitle someone to damages for malicious prosecution — malice and absence of reasonable cause must also be proven.
