PLJ 2025 Quetta 7 · Balochistan High Court
This case explains a property dispute about cancelling mutation entries (land ownership records) where the plaintiffs' suit was dismissed by the trial court for non-prosecution, meaning they failed to appear and present evidence. Their appeal was also dismissed. They then challenged both decisions before the Balochistan High Court.
The key issue was that the case had been rescheduled not by the actual judge, but through a note from the court's Reader (clerical staff), after the original judge was transferred. On the new date, neither the plaintiffs nor their lawyer appeared, so the suit was dismissed.
The High Court found this procedurally improper. It held that a hearing date fixed only through a court clerk's note, rather than by the presiding judge himself, cannot be legally treated as a proper "date of hearing." Therefore, the dismissal based on that date was void and without jurisdiction. The court also noted that the trial court had wrongly used the law (Order XVII Rule 3 CPC, meant for failure to produce evidence) instead of the correct procedure, and had failed to give the plaintiffs a fair opportunity to testify.
The High Court ruled that such technical lapses should not be used to defeat people's genuine legal rights. It accepted the petition, effectively reviving the case so it can be decided on its merits rather than on a procedural technicality. This judgment reinforces that courts must follow proper procedure and protect litigants' fundamental right to a fair hearing.
