Ashfaq Khalid etc V. State through D.G. NAB, Quetta etc.,
PLJ 2025 Cr.C. 628 · Balochistan High Court
This case involved two men, Ashfaq Khalid and Pervaiz Zaki, who worked as accounts officers at PTCL/WTR Quetta. The National Accountability Bureau (NAB) accused them of embezzling over Rs 1.94 crore between 1991 and 1999 by fraudulently recording payments to "daily wage staff" that either did not exist or were fewer than claimed, and pocketing the funds meant for their salaries. NAB had actually built four separate references (cases) against them on similar corruption allegations from the same period, but only sent three to trial while holding back the fourth.
After the three references went to trial, the accountability court convicted and sentenced both men, and the Balochistan High Court later ordered that their sentences in those three cases run concurrently (at the same time, not stacked one after another). NAB's own Chairman then acknowledged that pursuing the fourth reference separately would amount to double jeopardy—punishing the same people twice for essentially the same conduct—and NAB itself asked the trial court to close that fourth case. However, the trial court refused and pushed ahead with the trial anyway, also failing to decide the accused's request to dismiss the case.
The High Court found this improper. Citing Section 17(d) of the NAB Ordinance, which allows multiple similar offences committed over time to be tried together in a single trial, the court ruled that all four references should have been combined rather than prosecuted separately. Proceeding with a fourth, separate trial after conviction in the other three violated the rule against double jeopardy.
