FIA shall act in accordance with provisions of FIA Act and Rules of 2002
PLJ 2025 Civil (Note) 86 · Islamabad High Court
This case involved a man who repeatedly complained to the Federal Investigation Agency (FIA) alleging corruption, fake nursing college approvals, and financial irregularities within the Pakistan Nursing and Midwifery Council (PNC). He filed a petition in the Islamabad High Court asking the court to direct the FIA to register a formal criminal case (FIR) based on his complaints, arguing that the agency was taking too long and had been evasive.
The court explained that under the FIA Act and its 2002 Rules, the agency is required to first conduct an inquiry into complaints and is not legally obligated to immediately register an FIR before that process is complete. The judge found that the petitioner had failed to provide solid evidence backing his allegations, and that many of the issues raised actually fell within the PNC's own regulatory authority to handle internally.
More importantly, the court found the petitioner had not come to it with "clean hands." He had filed contradictory cases in different courts about the same PNC affairs, concealed earlier related litigation from this bench, and could not explain how he obtained certain official documents he submitted as evidence. The judge concluded he acted in bad faith, possibly as a proxy for other interests, and had misused the court's process.
As a result, the petition was dismissed, and costs were imposed on the petitioner for his conduct. The case underscores that courts expect honesty and transparency from litigants and won't force agencies to bypass their standard investigative procedures without solid justification.
