Issuance of Notice against money laundering allegation

PLJ 2025 Civil (Note) 67 · Lahore High Court

This case involved a challenge to a notice issued by the Federal Investigation Agency (FIA) against a citizen under the Anti-Money Laundering Act, 2010. The petitioner, Ahmad Bin Shahid, approached the Lahore High Court to contest a call-up notice dated 10.07.2024 through which the FIA had initiated an inquiry against him for alleged money laundering.

The petitioner argued that this notice violated the principles laid down by the same court in an earlier landmark case, Abdul Saboor v. Federation of Pakistan (PLD 2024 Lahore 244). That earlier ruling had held that under Section 9 of the Act, any notice issued to a person suspected of money laundering must, at minimum, clearly state the details of the alleged offence and the specific property said to have been acquired through proceeds of crime. This is necessary so the person can properly respond to the allegations. A notice lacking this information cannot be considered valid.

The court examined the notice issued to the petitioner and found that the FIA had failed to follow these requirements, making the notice invalid and issued without lawful authority. Accordingly, the court set aside the notice.

However, the court clarified that the FIA remains free to proceed against the petitioner following proper procedure, in line with the standards set out in the Abdul Saboor judgment. This case reinforces that investigating agencies must provide sufficient information in such notices to protect individuals' right to respond to serious allegations.
