Jurisdiction of Returning Officer in case of involvement in criminal cases
PLJ 2024 SC 921 · Lahore High Court
This case involved Malik Ahmad Usman Nawaz, a candidate for a Punjab Assembly seat (PP-254, Bahawalpur), whose nomination papers were rejected ahead of the 2024 general elections. The Returning Officer rejected his papers claiming his signature on the nomination form did not match the one on his CNIC. On appeal, the Appellate Tribunal upheld the rejection but for a different reason—that he was a proclaimed offender in a criminal case and thus a fugitive from law. The Lahore High Court later dismissed his petition, agreeing with the Tribunal's reasoning. The matter reached the Supreme Court.
The Supreme Court found both grounds for rejection flawed. First, the alleged signature mismatch was not legally sufficient grounds for rejection, since the law only allows rejection for mismatched signatures of a proposer or seconder, not the candidate himself, and in any case the mismatch was not shown to be "material." Second, the petitioner had already obtained protective pre-arrest bail, undermining the claim that his status as a proclaimed offender barred him from contesting. The Court also relied on an earlier ruling clarifying that being a proclaimed offender in one case does not affect a person's separate civil right to contest elections, unless the Constitution or election law specifically says so.
The Supreme Court set aside the lower rulings, ordered his nomination accepted, and directed the Election Commission to include his name and symbol on the ballot for the scheduled election. This case clarifies the lim
