PLJ 2024 Quetta 97 · Balochistan High Court
This case involved a dispute over money allegedly owed through post-dated cheques. The respondent (plaintiff) claimed he had given Rs. 80,00,000 to the appellant in 2016, of which only a small amount was repaid, and that the appellant issued cheques to cover the remaining balance. When those cheques bounced, the respondent filed a summary suit for recovery of Rs. 77,39,300 under Order XXXVII of the Civil Procedure Code, a fast-track procedure typically used for cheque and negotiable instrument cases. The trial court had ruled in the respondent's favor and decreed the full suit.
On appeal, the Balochistan High Court examined the evidence closely. It found that out of nine cheques relied upon, the respondent could only prove, through a bank representative, that two cheques (worth Rs. 5 lakh each) had actually bounced and were properly presented to the bank. For the remaining seven cheques, there was no evidence that they had ever been formally presented to the bank branch for payment. The court held that presentment of a cheque to the bank is a mandatory legal requirement before a payee can sue the drawer, especially under the summary procedure of Order XXXVII. Since this wasn't proven for seven cheques, the suit couldn't succeed on those.
The court therefore partly allowed the appeal, upholding the trial court's decision only for the two cheques that were properly proven, while rejecting recovery based on the other seven. This case reinforces that proper proof of presentment is essential in cheque-based recovery
