Muhammad Yaqoob V. Zahir Shah,

PLJ 2024 Quetta 21 · Balochistan High Court

This case is about a civil appeal filed before the Balochistan High Court by Muhammad Yaqoob, who had earlier sued Zahir Shah for defamation and damages of Rs. 2 crore under the Defamation Ordinance, 2002. Yaqoob claimed that Shah had made defamatory allegations against him while recording a statement before NAB authorities during an inquiry into land dealings in Gwadar. The trial court had dismissed his suit, and he challenged that dismissal before the High Court.

The High Court upheld the dismissal. It found that Yaqoob's plaint failed to specify crucial details required by law, such as when and where the alleged defamatory statements were made, who heard them, what exact words were defamatory, and how financial loss was calculated. The court noted these are mandatory requirements under the Civil Procedure Code's rules on pleadings. It also found the suit was filed too late: the legal notice to Shah was sent nearly eleven months after Yaqoob learned of the allegations, even though the Defamation Ordinance requires notice within two months and sets a six-month limitation period for filing such suits, which applies instead of the general Limitation Act since this is a special law.

The judgment matters because it clarifies that defamation claims require precise, detailed pleadings and must be filed within strict time limits, otherwise vague allegations without specifics cannot succeed in court, even if genuine reputational harm is claimed.
