Shah Jan Kareem and another V. Bashir and 2 others,
PLJ 2024 Quetta 172 · Balochistan High Court
This case involved a family dispute over land in Turbat, Balochistan. The petitioners (Shah Jan Kareem and another) claimed their late father had purchased the property in 1986 and built boundary walls on it. They alleged that Respondent No. 1 fraudulently obtained an NOC from the local Municipal Corporation in 2018, transferred the property into his name, and later began illegal construction on it. The petitioners filed a lawsuit seeking a declaration of ownership, a permanent injunction, and cancellation of the fraudulent property transfer (mutation).
However, both the trial court and the appellate court (Majlis-e-Shoora Mekran) rejected the plaint, pointing out that the petitioners had already filed an earlier, nearly identical lawsuit over the same property against the same parties, which had been rejected. When they appealed that earlier rejection, they withdrew the appeal without seeking permission to refile the case later.
The High Court upheld these decisions, applying the legal doctrine of res judicata, which prevents the same parties from re-litigating issues that have already been decided by a competent court. The judge explained that allowing a second suit on the same matter would be unfair, encourage endless litigation, and undermine the finality of court decisions. As a result, the court dismissed the petitioners' revision petition, meaning they could not pursue the same property dispute again.
