Ameer Muhammad and another V. State,
PLJ 2024 Cr.C. (Note) 245 · Balochistan High Court
This case involved a violent land dispute between two tribes, Shamozai and Badezai, in Quetta that ended in death and injuries. During the confrontation, gunfire was exchanged between both sides. Muhammad Farooq of the Badezai tribe was killed, and members of both groups were injured. Police registered separate cases based on each side's version, and the trial court proceeded with the Badezai group's version.
The trial court convicted Ameer Muhammad of murder under Section 302(b) of the Pakistan Penal Code, sentencing him to life imprisonment, while his co-accused Jan Muhammad was convicted for attempted murder and given a prison term. Both men appealed.
The defense argued that the complainant's side had actually come armed to the appellants' property, tried to occupy their land, and initiated the firing, causing serious injuries to the appellants themselves. They claimed this was a case of self-defense and that the trial court failed to properly assess who was the aggressor.
The High Court examined the evidence, including circumstantial details like property documents and the sequence of events, and concluded that the complainant party had approached the disputed land and stopped Appellant No. 1 from construction, which triggered mutual firing. Because of this, the court found the killing did not amount to the more serious offense under Section 302(b), but instead fell under Section 302(c), a lesser category of culpable homicide. The appeal was partly allowed, reducing the conviction and sentence accordingly. This case highlights how courts weigh conflicting versions of events and circumstantial
