Status of medical evidence is always corroborative in its nature

PLJ 2024 Cr.C. (Note) 240 · Federal Shariat Court

This case involved Abdul Moeen, who was convicted by a trial court in Dir Upper for a 1999 incident in which he and several co-accused allegedly broke into a house armed with firearms and abducted a woman, Mst. Naiba, to force her into marriage. When she resisted, she was shot and injured in both arms. The appellant absconded for over 21 years before being arrested in 2020 and tried. He was convicted under multiple sections of the Pakistan Penal Code and the Offence of Zina Ordinance, receiving various prison sentences and fines.

On appeal before the Federal Shariat Court, his lawyer argued that some witness statements used against him had been "transposed" (carried over) from earlier related trials of his co-accused without their supporting documents being formally re-exhibited, so they should not be relied upon.

The Federal Shariat Court rejected this argument. It held that once a statement is properly recorded and exhibited in one trial, those exhibits become part of that statement and do not need to be separately re-exhibited when transposed into a co-accused's later trial, provided the legal conditions under Section 512 of the Criminal Procedure Code and Article 47 of the Qanun-e-Shahadat Order are met. The court found the victim's testimony credible and well-supported by eyewitnesses, noting that medical evidence only serves a supporting role rather than being essential on its own. The conviction was upheld, reinforcing how courts handle evidence transposed from earlier related trials.
