Allah Almighty shows His love and affection with a person who speaks nothing except truth

PLJ 2024 Cr.C. (Note) 229 · Lahore High Court

This case concerned Bilal Arshad, who was convicted by a trial court in Faisalabad of murdering his uncle Nadeem Aslam and wounding another uncle, Ijaz Ahmad, following a quarrel that began when the deceased objected to the appellant entering the family home while armed with a pistol. The trial court had sentenced him to death for murder, along with separate prison terms and fines for house trespass, causing hurt, and injuring another person. The case came before the Lahore High Court both as the appellant's appeal against conviction and as a murder reference required for confirming any death sentence.

The High Court found that the prosecution had proved its case against the appellant beyond reasonable doubt, noting that when questioned during trial under Section 342 of the Criminal Procedure Code, the appellant admitted to the occurrence despite having contested the charges earlier. The court viewed this admission favorably, treating his eventual truthfulness as a mitigating factor. It also took into account that the appellant was a teenager at the time of the offense.

Based on these considerations, the court commuted the death sentence to life imprisonment, declining to confirm the death penalty. The murder reference was answered in the negative. This case illustrates how appellate courts in Pakistan can reduce sentences by weighing factors like the offender's age and conduct during trial, even after affirming guilt, and shows the interplay between criminal appeals and the mandatory judicial review of death sentences.
