302(b) - Modification in Quantum of Sentence
PLJ 2024 Cr.C. (Note) 227 · Lahore High Court (Multan Bench)
This case is about a double murder appeal from Dera Ghazi Khan. Ghulam Akbar was convicted by a trial court of killing his relatives' parents (Naseer Muhammad and Musarrat Wazeer) and sentenced to death on two counts, after the complainant alleged a family dispute over marriages had turned violent. Three co-accused were acquitted. Akbar appealed his conviction and death sentence, while the case also went before the High Court as a Murder Reference, which is required whenever a trial court imposes a death sentence.
The Lahore High Court (Multan Bench) examined the evidence, including eyewitness testimony from the complainant and his brother, medical evidence, and a forensic report. It found the eyewitness accounts credible and consistent, supported by medical evidence, and rejected the defense's claim that the real culprits had been substituted. However, the court noted that the prosecution had only produced a photocopy of the forensic report, not the original, making it inadmissible evidence.
The court upheld Akbar's conviction for murder but decided his case did not warrant the death penalty, citing certain mitigating ("extenuating") circumstances in his favor. It reduced his sentence from death to life imprisonment, applying the principle that doubt or weaknesses in a case can benefit an accused specifically on the question of sentence, even where conviction itself stands.
