Wajtakar Evidence Judgment
PLJ 2024 Cr.C. 943 · Lahore High Court
This case was heard by the Lahore High Court, which decided an appeal and revision petition arising from a murder conviction. The victims had died in an unseen occurrence, meaning no one directly witnessed the killing, so the prosecution relied entirely on circumstantial evidence, including witnesses who claimed to have seen the accused near the scene (called "Wajtakar" evidence) and recovered items allegedly belonging to the deceased.
The court found serious flaws in this evidence. The witnesses who claimed to have seen the accused could not properly establish their own presence at the relevant time and place, their account of events was vague, and the investigating officer failed to verify their claims through phone records or travel tickets. Other witnesses were "chance witnesses" whose presence at the scene was never justified. Since the prosecution failed to prove guilt beyond reasonable doubt, the court acquitted the accused, highlighting how weak investigation and impro
