Rule of Consistency in Conviction and Acquittal

PLJ 2024 Cr.C. 553 · Lahore High Court

This case involved five men—Asif alias Asad, Irshad, Muhammad Riaz, Shaukat Ali, and Jamshaid Ahmad—who were convicted by a trial court in Gujranwala for rioting while armed with deadly weapons, a crime under Section 148 of the Pakistan Penal Code. The case arose from a 2011 incident in which a group allegedly waylaid two brothers over a prior quarrel, resulting in one brother being shot dead by a co-accused who later became a proclaimed offender (fled from justice). The appellants were accused of being part of the armed group but had not fired the fatal shot or caused any injuries themselves.

The Lahore High Court overturned their convictions. It noted that several other co-accused, facing identical allegations, had already been acquitted by the trial court, and under settled legal principles, when the same role is attributed to multiple people and one is acquitted, the others cannot be convicted unless there is strong independent corroboration. The court also found that forensic reports about recovered weapons didn't actually link the appellants to the crime, and that the prosecution failed to prove the "common object" required to establish rioting under the law.

This judgment reinforces an important consistency principle in criminal law: courts must treat similarly situated co-accused equally, and convictions cannot stand on weak or inconsistent evidence when others accused of the same conduct have already been cleared.
